1. Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für die Vermietung des Ferienhauses in Rotonda West, Florida, USA, zwischen den Eigentümern bzw. Vermietern und den Gästen. Abweichende Vereinbarungen gelten nur, wenn sie ausdrücklich schriftlich bestätigt wurden.
2. Buchung und Vertragsschluss
Mit der Buchung, zum Beispiel schriftlich oder per E-Mail, kommt ein verbindlicher Mietvertrag zustande, sobald die Buchung durch die Vermieter bestätigt wurde. Die Buchung gilt für die im Vertrag oder in der Buchungsbestätigung angegebene Anzahl an Personen.
3. Zahlungsbedingungen
Der Gesamtbetrag ist gemäß den vereinbarten Zahlungsbedingungen zu bezahlen. Ein Anspruch auf Nutzung der Unterkunft besteht erst nach vollständigem Zahlungseingang, sofern nicht ausdrücklich etwas anderes vereinbart wurde.
4. Kaution
Eine Kaution kann verlangt werden. Die Höhe der Kaution und die Zahlungsmodalitäten ergeben sich aus dem jeweiligen Angebot oder der Buchungsbestätigung. Die Kaution wird nach ordnungsgemäßer und schadenfreier Rückgabe der Unterkunft innerhalb einer angemessenen Frist zurückerstattet.
5. An- und Abreise
Check-in und Check-out erfolgen zu den vereinbarten Zeiten. Abweichungen hiervon bedürfen der vorherigen Zustimmung der Vermieter.
6. Nutzung der Unterkunft
Die Unterkunft darf nur von der vereinbarten Anzahl an Gästen genutzt werden. Partys, Veranstaltungen oder eine gewerbliche Nutzung sind nicht erlaubt, sofern sie nicht ausdrücklich vorher vereinbart wurden.
7. Sorgfaltspflichten der Gäste
Die Gäste verpflichten sich, das Ferienhaus, die Einrichtung, den Außenbereich und das Inventar pfleglich zu behandeln. Schäden, Mängel oder Funktionsstörungen sind den Vermietern unverzüglich mitzuteilen.
8. Pool, Außenbereich und Sicherheit
Die Nutzung des Pools, des Außenbereichs und der gesamten Unterkunft erfolgt mit der gebotenen Sorgfalt. Eltern und Aufsichtspersonen sind für die Sicherheit von Kindern und anderen aufsichtsbedürftigen Personen verantwortlich. Die geltenden Hausregeln und Sicherheitshinweise sind einzuhalten.
9. Haftung
Die Nutzung der Unterkunft, einschließlich Pool, Terrasse, Garten und Außenbereich, erfolgt auf eigene Verantwortung der Gäste. Die Vermieter haften nur im Rahmen der gesetzlichen Bestimmungen. Die Haftung für Schäden aus der Verletzung von Leben, Körper oder Gesundheit sowie für Schäden, die auf vorsätzlichem oder grob fahrlässigem Verhalten beruhen, bleibt unberührt.
10. Stornierung
Für Stornierungen gelten die zum Zeitpunkt der Buchung vereinbarten Stornierungsbedingungen. Diese ergeben sich aus dem jeweiligen Angebot, der Buchungsbestätigung oder der individuell getroffenen Vereinbarung.
11. Hausregeln
Die jeweils gültigen Hausregeln sind Bestandteil des Mietvertrags und von den Gästen verbindlich einzuhalten. Dies gilt insbesondere für Regelungen zur Nutzung der Unterkunft, des Pools, der technischen Ausstattung, der Parkmöglichkeiten sowie zur Rückgabe des Ferienhauses.
12. Schlussbestimmungen
Sollten einzelne Bestimmungen dieser Allgemeinen Geschäftsbedingungen ganz oder teilweise unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. Anstelle der unwirksamen Bestimmung gelten die gesetzlichen Regelungen.

1. Scope
These Terms and Conditions apply to the rental of Villa Palm Valley in Rotonda West, Florida, USA, between the owners Denise and Guido Wenning and the respective guests. They apply in particular to direct bookings made through the website, by email, or through a booking system connected to the website. For bookings made through external platforms such as Airbnb, Booking.com, Vrbo, or similar providers, the respective platform terms may apply in addition to or take precedence over these Terms and Conditions.
2. Booking and Contract Formation
A booking becomes binding once it has been confirmed by the owners in writing, by email, or through the booking system. The booking applies to the period stated in the booking confirmation, the agreed rental price, and the specified number of guests. Individual agreements, information provided in the offer, or details in the booking confirmation take precedence over these Terms and Conditions if expressly agreed.
3. Number of Guests and Use
Villa Palm Valley is designed for a maximum of 6 guests. Use by more persons is permitted only with the prior express consent of the owners. Additional overnight guests, transfer of the accommodation to third parties, or subletting are not permitted. The accommodation may be used exclusively for private vacation purposes. Parties, events, commercial use, photo shoots, or film productions are permitted only with the prior express consent of the owners.
4. Prices, Taxes, and Fees
The agreed rental price is based on the respective offer, booking confirmation, or booking system. Additional costs, including but not limited to cleaning fees, taxes, service fees, or security deposits, will be stated in the offer or booking confirmation, where applicable. Where required by law, state or local taxes and charges may be imposed on the rental price and other services. These are to be borne by the guest unless they are expressly included in the total price.
5. Payment Terms
Payment shall be made in accordance with the payment terms stated in the offer or booking confirmation. Unless otherwise agreed, the booking is firmly reserved only after receipt of the agreed payment or deposit. The right to use the accommodation exists only after full payment has been received, unless expressly agreed otherwise. If a due payment is not received on time, the owners are entitled, after prior reminder, to withdraw from the agreement and rent the accommodation to another party.
6. Security Deposit
A security deposit may be required. The amount of the security deposit will be agreed individually and will be stated in the respective offer or booking confirmation. The security deposit serves to secure possible damages, missing items, excessive cleaning, unauthorized use, unreported pets, or other violations of the house rules. After the accommodation has been properly returned without damage, the security deposit will be refunded within a reasonable period of time. Legitimate claims may be offset against the security deposit. If damages or additional costs exceed the security deposit, further claims remain reserved.
7. Check-in and Check-out
Check-in is available from 4:00 p.m. Check-out must take place no later than 10:00 a.m. Earlier check-in or later check-out is possible only with the prior consent of the owners. Please note that the agreed times must be observed so that the villa can be cleaned and prepared on time for subsequent guests. Key handover or access to the accommodation will take place as agreed in advance.
8. Guests’ Duty of Care
Guests agree to treat the house, furnishings, technical equipment, outdoor areas, pool, garage, and inventory with care and respect. Any damage, defects, or malfunctions must be reported to the owners immediately so that clarification or repair can be arranged promptly. Unauthorized repairs or the engagement of third parties without prior coordination with the owners are permitted only in urgent emergencies.
9. House Rules
The applicable house rules form part of the rental agreement and must be observed by all guests. This applies in particular to rules regarding smoking, pets, pool use, grill use, parking, trash disposal, quiet hours, safety, and return of the accommodation. In the event of serious or repeated violations of the house rules, the owners may terminate the stay. In such case, no refund will be made for unused rental time, to the extent permitted by law.
10. Smoking, Fire, and Grill
Villa Palm Valley is a non-smoking home. Smoking inside the house is not permitted. Please use only suitable outdoor areas for smoking and dispose of cigarette butts safely and completely. Open flames are not permitted. The grill may only be used in the designated outdoor area. After use, the grill must be cleaned and safely turned off.
11. Pool, Lanai, and Outdoor Area
Use of the pool, lanai, patio, garden, and outdoor areas is at the guests’ own risk. Children may use the pool and outdoor areas only under constant adult supervision. Glass bottles and glass containers are not permitted in the pool area in order to avoid injuries and damage. Use of the pool during thunderstorms, storms, or other dangerous weather conditions is prohibited. Guests are required to act responsibly and observe all safety and usage instructions.
12. Canal, Waterfront Location, and Wildlife
The villa is located directly on a freshwater canal. The canal is not intended for swimming or bathing. Please keep children away from the canal area in particular and maintain a safe distance from the water at all times. In Florida, wildlife may be present in and around bodies of water, including alligators, snakes, turtles, birds, and other animals. Wildlife must not be fed, touched, disturbed, or attracted. Please keep a safe distance at all times.
13. Pets
Pets are permitted only if expressly agreed and confirmed before booking. The type and number of pets must be disclosed in advance. Guests are liable for all damage, additional cleaning costs, or complaints caused by pets. Pet waste must be removed immediately. Pets must not be left unattended in a way that could cause damage to the house, furniture, or outdoor areas.
14. Quiet Hours and Neighborhood
Villa Palm Valley is located in a quiet residential neighborhood in Rotonda West. Please be considerate of the neighbors and avoid excessive noise. Parties, loud music, and larger gatherings are not permitted. Quiet hours are from 10:00 p.m. to 8:00 a.m., unless stricter local rules apply.
15. Parking and Vehicles
Vehicles may be parked only in the designated areas. Parking on lawns, sidewalks, or unauthorized areas is not permitted. Boats, trailers, RVs, or additional vehicles may be parked only by prior arrangement, provided this is permitted locally.
16. Cleaning and Return of the Accommodation
Final cleaning is included in the booking where agreed or will be charged separately. Regardless of this, guests are asked to leave the accommodation tidy and in reasonable condition. Before departure, guests must in particular dispose of trash in accordance with the instructions, place dishes in the dishwasher or start it, remove leftover food, take all personal belongings, and close doors and windows. Excessive soiling, improper use, or additional cleaning effort may be charged separately.
17. Technical Equipment, Internet, and Utilities
The villa is equipped with technical amenities such as Wi-Fi, Smart TV, air conditioning, household appliances, and other equipment. Guests agree to use these items properly. Temporary interruptions of internet, electricity, water, air conditioning, pool equipment, or other utilities may occur, particularly due to weather, technical issues, maintenance, local providers, or force majeure. In such cases, the owners will make reasonable efforts to arrange a timely solution but cannot guarantee uninterrupted availability.
18. Weather, Hurricanes, and Force Majeure
Florida may be affected by heavy rain, thunderstorms, tropical storms, or hurricanes. Guests are required to observe weather alerts, official notices, and evacuation orders. If the owners are unable to provide the accommodation due to force majeure, official orders, evacuation, severe damage, technical uninhabitability, or other circumstances beyond their control, the owners are entitled to withdraw from the agreement or offer a rebooking. Travel, flight, rental car, meal, or other consequential costs incurred by guests will not be covered. Guests are advised to obtain appropriate travel insurance.
19. Cancellation by Guests
Cancellations are subject to the cancellation terms agreed at the time of booking. These terms are set out in the respective offer, booking confirmation, or booking system and are stated there separately. The relevant time is the time at which the cancellation is received by the owners in writing, by email, or through the booking system. In the event of no-show, late arrival, or early departure, there is no entitlement to a refund for unused nights unless expressly agreed otherwise.
20. Liability of Guests
Guests are liable for all damage caused during the stay by themselves, fellow travelers, visitors, children, or pets. This applies in particular to damage to the building, furnishings, inventory, pool, outdoor areas, technical systems, and neighboring properties. Damage must be reported immediately.
21. Liability of the Owners
Use of the accommodation, including the pool, patio, garden, outdoor areas, and proximity to the canal, is at the guests’ own risk. The owners are liable only within the limits provided by law. Liability for damages resulting from injury to life, body, or health, as well as for damages caused by intentional or grossly negligent conduct, remains unaffected. No liability is assumed for guests’ personal belongings, valuables, cash, jewelry, electronic devices, or vehicles, to the extent permitted by law.
22. Problems During the Stay
If anything is not working, damaged, or gives reason for complaint during the stay, we ask guests to notify us immediately. Only then can the issue be addressed in a timely manner. Complaints reported only after departure can generally no longer be reliably verified or remedied.
23. Governing Law and Controlling Language
This agreement is governed by the laws of the State of Florida, USA, to the extent permitted by law. Mandatory consumer protection provisions that may apply in individual cases remain unaffected. If these Terms and Conditions are provided in multiple languages, the German version serves to inform German-speaking guests. In case of doubt, the booking confirmation should specify which language version is controlling.
24. Final Provisions
If any provision of these Terms and Conditions is or becomes invalid in whole or in part, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the applicable statutory provisions. Changes or additions to individual agreements must be made in text form, unless a stricter form is required by law.
